A White Knight Coming to Run Against Banales


It is whispered that a 36 year old lawyer with bipartisan support is raising a large amount of money to make a run against Manuel Banales. What is also reasonably believed is that Watts and Vela may join forces to aid him. Who is this Obama-like creature who lurks in the shadows and wishes to straddle power in the 105th?. The revelation will come soon enough. And when that seal is broken perhaps a "just reign"(Divinci Code hint my friends) will occur in Nueces County once again. Soon enough we shall discover who this man who is above reproach and who's reputation is blemishless and who will be conquered and will announce and bring out all the truth which will uncover all of the corruption with full state and federal support. Many are already trembling. Beware he comes soon. What we do know that it is a short list of young hispanic males who perhaps have thrown their hat in before or have contemplated it. " Banales should have bowed out of presiding over anything with Celis. Darrel Barger the defense attorney represents Celis. He employs or has employed Banales' kids in some form of fashion and that is the least of the conflicts. This has never been disclosed to the public or other lawyers on the other side for years and should also be looked into. It was political suicide for Banales to do this and people will want his seat. It sends a clear message when you bring in a conservative Republican Judge from Tarrant County. Don't take my word for it. Check the facts and look at the H&R Block cases. Enjoy the research. Banales has left two men cripple and got a speeding ticket for it and now is arrogant enough to try to pull this off. When are the voters going to say enough and vote him out? Who's afraid of the Big Bad Banales Wolf? Not Judge Sturns or Austin or the Feds, that's for sure. Banales comment that the jails are overcrowded in the Celis case is laughable at best and hypocritical at most. He has put so many people in jail for long stretches and nonviolent crimes that we the taxpayers have a hole burning in our pockets. It's a new day. Let Tina Trevino, Angelica Hernandez or some other qualified young man take the bench. The era of Barger and Banales is over.

Marisela Saldana Announced her run for Judge in the 148th District Court. She has also made the local talkshow circuit and was seen by many last nite interviewed on KTMV quoted as talking tough about anyone running against her that she will fight for her seat. She categorized the attacks on her record by past opponents regarding her record of being tardy and keeping jurors waiting as nasty and inaccurate. Saldana has gone hi tech as well and can be seen on youtube.com interviews and political announcements. Saldana is in her 16th year on the bench. Challengers are perhaps David Stith a young lawyer in town running on the Republican ticket and it has yet to be confirmed that Guy Williams will also run. Last election Guy came close but was not successful( Judge Jose Longoria referred to him as the perennial candidate when he challenged him unsuccessfully). Marisela has come out early and come out strong as has Tom Greenwell to scare off any candidates. Marisela is known as a tough competitor and a former social worker and lawyer. Many have tried to topple her from her Court 3 seat and now her seat on the 148th district court. Marisela is only the 3rd female judge in Nueces County (Haas and Tegle were the 1st and 2nd). The Guy Williams and Saldana war looks like it is going to start up again.

Tom Greenwell had several fundraisers last week. As the only Republican Judge will someone throw in their hat against him???. Last election he bested Robert Zamora and is categorized by most attorneys as hardworking and smart. Will the bad taste many have in their mouth with the Republicans and the last 8 years hurt him? Will his relationship with the Scotts also be damaging?. Mike Scott apparently is pushing hard for him and trying to recruit loyal democratic women and hispanic males to run as Republicans (HIS WIFE was trounced by Abel Herrero who many say is unbeatable after having to endure the Scott mudslinging and dirty campaigning and attempts to report him to federal and state agencies for false home health violations which proved groundless). Many of the Republicans are reportedly playing the same old record of party line exclusion of minorities unless expedient, haters of anything that is inclusive and even in these economic times raging against "Obama" whom they apparently can't acknowledge as president. Nevertheless, Greenwell is viewed as a topnotch judge by many and although swept in by Republicans has been reportedly fair to all. Many moderate Republicans have grown weary of the white supremacist and intolerant views of the Republicans locally and nationally. How many times must we endure Karl Rove on FOXX attempt to explain how his administration he controlled through Bush cause us to lose so much freedom, lives, and rights and smear the United States' good reputation around the world through human rights violations and torture? It's a brave new world Mike Scott. No amount of mudslinging and attacking Abel's wife will fix that. But i digress...

With Barack Obama in the Whitehouse but Republicans controlling Texas what will happen to local races? The Republicans perhaps should lay low here locally but with the Solomon -Neal debacle over Ingleside there is strife already, promising for a perfect storm in politics.

Below is the article by San Antonio reporter John MacCormack who also has followed the Celis story since 2007. Apparently Banales has been bought and paid for by the Celis Camp and not just Darrell Barger who appeared in front of him on hundreds of cases while his children worked for Barger and never disclosed that to the other attorneys.


Can Tina Trevino or Angelica Hernandez or a host of other strong Latina Candidates finally expose Banales for what he is and his reign of terror over lawyers and people who couldn't afford to influence him who faced stiff sentences?. Maximum Manuel indicated that the jails were too overcrowded for Celis but yet he placed many in jail for much more minor offenses. The hypocrisy runs deep and his political days may be short.

CORPUS CHRISTI Over the past two decades, many a South Texas defendant has feared a sentencing by state District Judge Manuel Bañales, who's known for meting out harsh and creative punishments.
In 1993, the judge made headlines by sentencing a first-offense drug smuggler caught with 54 pounds of marijuana to 54 years in prison. The conviction later was overturned and the man went free.
Eight years later, Banalesales again made national news by ordering sex offenders in Nueces County to place signs describing their offenses in front of their homes and on their cars.
Other offenders have been ordered to serve lengthy jail sentences in small installments, year after year, during the Christmas holidays.
He'sa no-nonsense judge who is very severe in sentencing. Very harsh,said Albert Pena III, a veteran criminal defense lawyer.
Thus, when Banales appeared to show leniency this spring after stepping into a high-profile case involving the state's most prominent fake lawyer, Mauricio Celis, the natural legal order shuddered.
That's not the Judge Banales I've known all these years. It's a different one. Maybe he's mellowing, said Pena, one of the few willing to speak on the record.
Banales' deepening role in the case has triggered a public showdown with prosecutor Carlos Valdez. The longtime Nueces County district attorney wants Banalesoff the case, claiming he hasn't been impartial.
I'm doing something that has not been done before. And when you take on a judge publicly, there may be consequences later, Valdez said.
Impersonating a lawyer
The improbable figure at the center of it all is Celis, a man who overcame his modest origins to open his own Corpus Christi law firm, earn an estimated $10 million mostly in case referral fees from lawyers and play the role of high-dollar rainmaker in Democratic political circles.
He did it all with brains and chutzpah, without even being a lawyer.
After he was denounced as a fraud two years ago, Celis added a colorful subplot to the story by chasing down a nude woman, who had fled his hot tub, while flashing a police badge and clad only in a bath robe.
As the criminal charges and civil suits piled up, Celis insisted he had a law degree from Mexico, dropping that claim only after being convicted of 14 felony counts of impersonating a lawyer.
The trial was heard by visiting Judge Mark Luitjen who was appointed by Bañales.
However, in May, just before the Celis sentencing, Banales removed Luitjen on a recusal motion.
The defense also asked for a new trial, claiming in both motions that Luitjen had been unfair.
As proof, seven jurors testified that he showed bias against Celis, and Banales took over the case.
But where Luitjen had outlined a sentence of a year in jail, probation and restitution of more than $1 million, Banales gave Celis 10 years' probation and reduced restitution to proven claims by victims.
It was almost identical to what the jury had recommended for Celis, who faces at least three more trials on related charges.
Assumingthat what Mr. Valdez says is true, that this defendant is a con artist of the greatest magnitude, that in and of itself does not warrant incarceration,Banalessaid at sentencing, noting the offenses did not involve violence or injury, and that local jails were crowded.
To some local lawyers, it didn't add up, but because Banales' reputation for harshness extends to his critics, few would speak on the record.
This was not business as usual. I think he did the guy (Celis) a favor. If this had been Joe Blow off the streets, he'd be doing his year in jail, one veteran defense lawyer said.
Said another lawyer, Banales is a stinker all the way around. Maybe Luitjen rolled his eyes a little bit, but that's never been grounds for recusal.
But not everyone thinks the sentence of probation was out of line.
Mauricio Celis isn't going to harm anyone, said James Granberry, who has practiced before Banales
I didn't get a lot of heartburn about him not going to jail. Those beds are for people who keep me awake night, prying in my windows, he said.
The nuclear option
While online conspiracy theorists in Corpus Christi speculated wildly this spring about dirty deals in the Celis case, Valdez activated what he called “the nuclear option.
Days before a June 26 hearing on a new trial for Celis, he filed a motion to remove Bañales, claiming his impartiality was suspect.
“Judge Banales came in and undid everything that Judge Luitjen had done. And if he grants the motion for a new trial, we're back to Square 1,he said.
In his motion, Valdez outlined the judge's financial and social links with various defense lawyers who have an interest in the Celis case, foremost Tony Canales, the lead defense lawyer.
The things we have raised went on outside the courtcampaign contributions, socializing with the judge, and the possibility that Judge Banales is in line for a federal judgeship and that Tony Canales would be the perfect conduit to help him,Valdez said.
A man of expansive ego and ambition, Bañales lost out on a bid in 1993 to become a federal judge in Corpus Christi. Rumors floating around town have him as possible replacement for U.S. District Judge Hayden Head Jr. who is expected to step down in October.
Because Canales is a member of a state judicial selection committee and a reputed kingmaker, he is well positioned to help Banales, according to Valdez.
“And if he thinks Tony can get him in, Tony is in the perfect place to get what he wants from the judge. It just doesn't look right,said.
Canales and Banales declined to be interviewed for this article.
In their response to the recusal motion, Celis' lawyers say it was filed too late, that taking campaign contributions from lawyers isn't grounds for recusal, and neither are the judge's social ties.
The real bloodshed might lie ahead, because last week Banales declined to step down.
“The state presents no legal basis upon which I should recuse myself, he wrote.
This throws the recusal issue to Chief Supreme Court Justice Wallace Jefferson, who either will hear the issue himself or assign another judge.
In a full-blown hearing, reputations are likely to be harmed.
According to District Judge John Hyde of Midland, a recognized authority on recusals, several aspects of the legal drama playing out in Corpus Christi are noteworthy.
“I don't think I've ever seen a case where a recusal occurred at the end of a trial,†he said, after reviewing some pleadings. Normally, he said, appellate courts are the remedy for alleged trial bias.
“The fact that the motion for a new trial is almost a mirror image of the recusal motion indicates those are matters for an appellate ruling, he said.
He said it's not customary for an administrative judge who grants a recusal to then assign himself the case. He also found the issues of outside influence raised by Valdez unsettling. On the whole, the entire case is not helping the image of the judiciary, Hyde said.

"I feel bad for Mr. Huerta but I can't believe how gullible people are. The Catholic Church got bought out and the media by Huerta and all the trial lawyers. Did you see when Huerta became ill how many comments were removed from the Caller Times? The media suppressed any negative comments and even Joe Gazin from 3 Eye Witness News called Huerta the Spiritual Leader and "Prominent Lawyer". This whole thing that Albert started was a machine to get clients. Joseph his son was not the reason. Mr. Huerta had been engaged in Johnny Land and used that to bring in clients. When that got in hot water he looked at Gospel Bands and the preachers and saw it as an opportunity to get clients. It was something different and apart from Joseph and preceeded Joseph's accident in 1998. Albert and other lawyers got together to run cases. Albert saw religion as a way to get cases. Perhaps in his grief over Josephhe began to be delusional that he could talk to God. "






"However, I saw firstahnd that he would fly in mystics and people from the occult in the 1990's and reach out to Cabala, Curanderismo, Santeria and other arcane arts. And those that wanted to be a part of his machine had to engage in this Santeria-like worship. It was only recently that Our Fathers House began to appear on television and to have a critical mass effect on a lot of people. Conveniently this organization coincided with attempted to heal catastrophic illness in those involved accidents and it was clear that it was to a lure to get in hurt people to sign up with the firm. The Catholic Churc`h was used as a front and elderly priest was used to legitimize this enterprise and the Catholic Church looked the other way just like with Mauricio Celis. Conveniently those involved were high placed runners and lawyers. It is clear that even the Catholic Church has been coopted. Fellows growing up with him even say that there were some bizarre behaviors at Johnnyland evern before Joseph's accident. Huerta was mesmerized by religion and its effect on mind control and control of the masses and the huge opportunities to get cases. There were other strategies like using musicians but that was too risky because of the links to the underworld and drug trade. With religion and the stamp of certain elite members of the Catholic Church wcich would benefit from his generosity Huerta became bulletproof. Only a stroke and the hand of God has humbled him and now the other henchman are running for cover."

" YOu have to remember that a lot of millions were made off the misfortune of others and my hands are not clean. I helped Huerta make that money. I saw Calderon and DeLeon also run cases for Huerta and they made more than most lawyers in a lifetime and were happy to help in the religious movement and to get the clients that were paralzyed and forever disfigured to become clients or part of the machine that would bring in clients. A perfect example was a burn victim used to recruit new cases at the burn unit at Memorial here in Corpus for Huerta. He was paid to wait around for grieving families( supposedly). But what I do know is that cops, funeral people, fireman, EMS, nurses, Home Healths, and police chiefs and international figures all participated in running cases, Even reporters were hired from the stations to help knock on doors and get clients. This is the truth about Huerta. I like the man and I wish him the best, but the use of priests and the disgrace that has been brought on the Catholic Church and the frraud that has gone on for two decades is over. Kepp my name out of it because my life has already been threatened by these lawyers that run cases that stand to lose money. I hear that those who went and knocked doors will be investigated and the lawyers behind them are going to be sued more and more. Can you imagine that he requested and paid for an audience with the Vatican to start all this. If Catholics knew more about all this they may not have flocked to Huerta so quickly".

Statement From Congressman Solomon P. Ortiz Regarding the Ingleside Local Redevelopment Authority that addresses the closure of Naval Station Inglesid

Today, Congressman Solomon P. Ortiz released the following statement regarding the Ingleside Local Redevelopment Authority that addresses the closure of Naval Station Ingleside:

In my efforts to continue to provide jobs for my district, especially the area impacted by the closure of Naval Air Station Ingleside, I commend the hard and successful work of the Planning LRA, which was formed just a little over two years ago. At the request of the Ingleside Local Redevelopment Authority, I have taken the initiative to secure $3 million for the economic revitalization of my district.

My committee, the Armed Services Committee, has started the process for this funding and has authorized it in the 2010 Defense Authorization bill. This bill still has a long way to go to clear the Senate and numerous conference committee meetings and then pass both bodies of Congress and ultimately be signed into law by the President.

After its formation, the Ingleside LRA moved in and immediately started producing positive results. As a matter of fact, the hard work of the LRA has now put the community where they are ready for the next step, which is to form an Implementation LRA. When formed and approved by the Department of Defense, Office of Economic Adjustment (OEA), the Implementation LRA will receive and administer any monies to help revitalize our area’s negative impact due to the base closure.

In moving the LRA agenda forward, I have deep concerns about the recent nomination of Nueces County Judge Loyd Neal to the Implementation LRA.

Loyd Neal has continuously opposed the Ingleside LRA, from its formation, to its implementation, to its current make up. Loyd Neal had two chances to serve on the LRA, both times he declined, even considering it, “hypocritical for me to serve on this,” according to a August 9, 2007, article published in The Caller-Times. According to a June 20, 2009, article published in The Caller-Times, Neal said that at that time he was “opposed to the representation on the authority” because of politics.

My question to Neal: Which is it?

Furthermore, Loyd Neal has served as an obstructionist to collaborative efforts like the LRA.

As part of the Coastal Bend Redevelopment Planning Committee, which was ultimately dissolved because of its serious and substantial political in-fighting, Loyd Neal’s defiance resulted in the Committee’s application being rejected by the Department of Defense and the loss of millions of dollars to the Coastal Bend, according to an article published on Feb. 13, 2007, in The Caller-Times.

The Department of Defense’s Office of Economic Adjustment has not approved the Coastal Bend Redevelopment Planning Committee, formed in January 2006. Disagreement among neighboring jurisdictions about who should sit on the nine member committee has made it one of the last of about 120 communities nationwide to be recognized, said Richard Tenga, a Defense Department Project manager,” according to the article published on Feb. 13, 2007, in The Caller-Times.

This isn’t about any one family member serving on this board, this is about moving the Coastal Bend area forward and creating jobs and economic prosperity for all by appointing progressive-minded people to serve this community we all love and care for.

Other communities have received millions in funding from the federal government, and we are still dealing with local political in-fighting. My work in Congress is serious and I must do all I possibly can to represent my constituents.

Facts:

On Feb. 13, 2007, The Caller Times reported: “Councilman Willie Vaden strongly opposed Nueces County’s requests to lead the committee. ‘What you see here is a movement by Nueces County to take over,’ he said.”

In that same article, Neal put out a memo to Nueces County Commissioners, and The Caller-Times reported: “He said he asked San Patricio County Judge Terry Simpson, who chairs the redevelopment authority, that Neal serve as the chairman and that a Nueces County Commissioners Court assistant be appointed as the committee’s executive director. They also asked that the committee use Nueces County’s hired attorneys and base operations out of the Nueces County Courthouse.”

On Aug. 9, 2007, The Caller-Times reported: “County Commissioner Betty Jean Longoria moved to name (Nueces County Judge Loyd) Neal and Commissioner Oscar Ortiz as the county’s appointees shortly after Neal said he would not support the development authority because of the way it was written. ‘I can’t serve on that.’ Neal said. ‘I don’t support it. It would be hypocritical for me to serve on this.

‘I don’t agree with the method and I don’t agree with the organization as approved,’ Neal said. ‘I am sure Mr. Cazalas and Mr. Ortiz will do a fine job, but I can’t support what’s going on.’”

After arresting three Minutemen vigilantes involved in the murder of the Flores family in Arivaca, Arizona on May 30th, Pima County Sheriff's detectives are now actively seeking a fourth they believe participated in the home invasion and killings. The mother who took three shots from the vigilantes in the after midnight invasion of her home told detectives that the murderers consisted of a group of three men and one women.

Already arrested are Shawna Forde, National Director of the Minutemen American Defense organization and its Director of Field Operations, Jason Eugene "Gunny" Bush. Arrested also, along with the two officers of the Minutemen group based in the state of Washington, was Albert Robert Gaxiola from Arizona.

Detectives have now determined that the shooter of 8-year-old Brisenia Flores was Jason Eugene "Gunny" Bush. Grisly details of the murder of Brisenia and her father Raul Flores are now emerging. Jason Eugene "Gunny" Bush has also been charged with the 1997 stabbing death of a Mexican youth in the state of Washington. Brisenia Flores was a third grader at Sopori Elementary School.

These murders and other violent acts against Mexicans, Mexican-Americans and other Latinos by the Minutemen are sure to have grave consequences. There are now Latino civil and human rights organizations calling for the US Department of Justice to declare the Minutemen a domestic terrorist organization. These civil and human rights groups are also calling for "border vigilantism" to be officially defined as a federal hate crime.
